Terms of Service

Practical terms for a month-to-month website service.

These terms apply when Osvira Media Solutions designs, hosts, maintains, or updates a website or related digital service for a client. They are intended to set clear expectations around free trials, monthly billing, cancellation, content ownership, support, and service limits.

1. Services

Osvira Media Solutions provides website design, website setup, copy and layout implementation, hosting coordination, basic maintenance, and related digital support as agreed with the client. Specific deliverables may vary by plan, proposal, or written agreement.

2. Free Trial

If Osvira offers a free trial, the trial applies only to the period and scope stated on the website or in writing. The trial is intended to let the client review the service before starting paid service. Osvira may limit, end, or refuse a trial where there is abuse, fraud, repeated misuse, or unreasonable setup demands outside the advertised offer.

3. Monthly Billing and Renewals

Paid plans are billed on a recurring monthly basis unless stated otherwise in writing. By starting a paid plan, the client authorizes recurring charges for the selected service until the service is canceled. Fees are due in advance for each billing cycle.

4. Cancellation

Clients may cancel a month-to-month plan at any time before the next billing date to avoid future renewal charges. Cancellation stops future billing only. Charges already paid for the current billing period are generally non-refundable unless Osvira agrees otherwise in writing.

5. Late or Failed Payment

If a payment fails or remains overdue, Osvira may pause updates, suspend services, remove premium integrations, or temporarily unpublish the website until the account is brought current. Osvira may also charge the client for reasonable third-party costs caused by chargebacks, payment disputes, or repeated failed collections.

6. Client Responsibilities

The client is responsible for supplying accurate business information, lawful content, correct contact details, rights-cleared images, logos, and other materials needed to build or maintain the site. The client is also responsible for reviewing work and providing approvals or revision requests in a timely manner.

  • The client must have the right to use any content they provide.
  • The client must not ask Osvira to publish unlawful, misleading, infringing, abusive, or fraudulent material.
  • The client remains responsible for the accuracy of claims made about their business, pricing, licensing, offers, and services.

7. Ownership and Access

The client retains ownership of their business name, trademarks, logos, and original content they provide. Osvira retains ownership of its internal methods, design systems, templates, reusable code, process documents, and service workflows unless transferred in writing.

If the service includes a promise that the client receives a static copy on cancellation, Osvira will provide a reasonable export of the finished website files that were part of the active service. Third-party software, licensed assets, paid plugins, hosted tools, analytics accounts, chat tools, payment tools, and proprietary systems may not be transferable.

8. Support and Changes

Support covers the level of changes included in the selected plan. New features, major redesigns, extensive rewrites, custom app integrations, emergency work, or work outside plan scope may require a separate quote or a higher-tier plan.

9. Third-Party Services

Websites may rely on third-party services such as hosting providers, domain registrars, payment processors, form providers, maps, chat tools, analytics tools, or scheduling tools. Osvira is not responsible for downtime, policy changes, price changes, or service interruptions caused by third parties.

10. No Guarantee of Results

Osvira does not guarantee rankings, leads, sales volume, response rates, ad performance, revenue, or any specific business outcome. Website performance depends on many factors outside Osvira’s control, including competition, ad spend, service quality, response speed, location, reviews, and market demand.

11. Refunds

Unless required by law or agreed otherwise in writing, payments already made are non-refundable once services, setup work, or the active billing period has begun. If Osvira grants a refund as a goodwill exception, that does not create an ongoing obligation to offer refunds in similar cases.

12. Liability Limit

To the maximum extent allowed by law, Osvira Media Solutions is not liable for indirect, incidental, consequential, special, exemplary, or lost-profit damages. If Osvira is found liable for a claim arising from the service, the maximum total liability will not exceed the amount paid by the client to Osvira for the specific service during the three months immediately before the event giving rise to the claim.

13. Termination for Abuse or Risk

Osvira may refuse, suspend, or terminate service where there is abuse, threats, harassment, fraud, unlawful conduct, repeated non-payment, chargeback abuse, reputational risk, or requests that would expose Osvira to legal or platform risk.

14. Updates to These Terms

Osvira may update these terms from time to time. The latest version posted on this page applies going forward from its posted date. Material changes should be reflected on this page with an updated effective date.
